The Deadline Inside the Deadline
Georgia gives injury victims two years from the date of injury to file most personal injury claims, including product liability claims. Most people know that much.
What catches people off guard is the second deadline sitting underneath it. Under O.C.G.A. § 51-1-11, a strict liability claim cannot be brought more than 10 years after the product was first sold new to its original consumer, no matter when the injury actually occurred. The clock starts at that first sale, not at manufacture, and not at the moment you got hurt.
Negligence-based claims have narrow exceptions, most notably failure-to-warn claims and injuries from long-term chemical exposure, but strict liability claims don't get that flexibility. Georgia's Supreme Court has also ruled that when the same product is purchased repeatedly over the years, such as a chemical or consumable good, each purchase starts its own separate 10-year clock rather than one deadline covering every unit you've ever bought. That means a product can be perfectly within your two-year injury window and still be barred entirely by the older, quieter ten-year rule. Getting both deadlines checked immediately, not eventually, is often the difference between a viable case and one that's already over.
